Recently, a client from 𝒕𝒉𝒆 π‘Όπ’π’Šπ’•π’†π’… 𝑺𝒕𝒂𝒕𝒆𝒔 𝒂𝒑𝒑𝒓𝒐𝒂𝒄𝒉𝒆𝒅 us for assistance with obtaining 𝐅𝐨𝐫𝐦 41. He was receiving a sponsorship fee from one of India’s most prestigious companies. As part of their compliance requirements, the Indian company requested several documents, including a 𝑻𝒂𝒙 π‘Ήπ’†π’”π’Šπ’…π’†π’π’„π’š π‘ͺπ’†π’“π’•π’Šπ’‡π’Šπ’„π’‚π’•π’† (𝑻𝑹π‘ͺ), a 𝑡𝒐 π‘·π’†π’“π’Žπ’‚π’π’†π’π’• π‘¬π’”π’•π’‚π’ƒπ’π’Šπ’”π’‰π’Žπ’†π’π’• (𝑡𝒐 𝑷𝑬) declaration, and Form 41.

The client already had his 𝑻𝑹π‘ͺ 𝒂𝒏𝒅 𝑡𝒐 𝑷𝑬 π’„π’†π’“π’•π’Šπ’‡π’Šπ’„π’‚π’•π’† in place but was unsure about the processfor obtaining Form 41 in India. He also had a PAN, which had likely been arranged earlier by the Indian company on his behalf.

He reached out to us via email to check if we could assist. We promptly scheduled a video call to understand his situation and guide him through the process.

During the call, we helped him register on the Indian Income Tax Portal. He had been facing an issue during registration because he had not selected his correct status as a non-resident/foreign entity, which prevented the process from moving forward. Once we guided him to enter the correct details, his company was successfully registered on the portal.

We then proceeded with filing the necessary details for Form 41. We collected his TRC and entered the relevant information, including the applicable financial year for which the form was being requested.

The next step was obtaining a π‘«π’Šπ’ˆπ’Šπ’•π’‚π’ π‘Ίπ’Šπ’ˆπ’π’‚π’•π’–π’“π’† π‘ͺπ’†π’“π’•π’Šπ’‡π’Šπ’„π’‚π’•π’† (𝑫𝑺π‘ͺ), which is mandatory for foreign applicants to verify the form online. Typically, a valid passport is required for this process for foreign applicants. However, the client’s passport had expired. Despite this, we were able to successfully arrange the DSC using alternative documents, such as his U.S. driving license and utility bill.

Through this structured approach, we were able to complete the entire process smoothly and help the client obtain Form 41. Although he was initially quite stressed about the requirements, he felt relieved once everything was handled efficiently.

While the process is straightforward for us, given our familiarity with the Indian Income Tax portal, it can be quite challenging for foreign applicants and may even disrupt their business operations.

For us, this was a routine assignmentβ€”but seeing the client relieved and satisfied reinforced that our work genuinely made a difference.
