How to apply PAN by foreign Company in India?

A foreign company can apply for a Permanent Account Number (PAN) in India for various purposes, including setting up a business, paying taxes, or complying with Indian tax laws. Here's a step-by-step guide on how a foreign company can apply for a PAN in India:

1. Determine the Need for PAN

  A PAN is required if the foreign company has a taxable income in India, needs to open a bank account, or engages in any financial transactions that require a PAN like in case foreign company has invested share capital in an Indian Company of more than Rs. 10 lakhs, then in such case foreign Company needs to apply for PAN 

2. Choose the Appropriate Form

  Form 49AA: This form is specifically for individuals, entities, and companies not incorporated in India, including foreign companies.

3. Gather Required Documents

  Proof of Identity: Certificate of Incorporation issued in the country where the foreign company is incorporated, attested by the Indian Embassy or Consulate.

  Proof of Address: Registered office address proof in the home country, attested similarly.

  Proof of Date of Incorporation: A certified copy of the registration certificate from the appropriate authority.

  Registration Certificate in India: If applicable, a copy of the registration certificate issued by Indian authorities.

4. Appoint an Authorized Signatory

  The foreign company must appoint an authorized signatory, who can be an individual holding a valid PAN in India. The signatory will be responsible for signing the application form and managing any communication related to PAN.

5. Fill Out the Application Form (Form 49AA)

  The form can be filled out online through the NSDL (National Securities Depository Limited) or UTIITSL (UTI Infrastructure Technology and Services Limited) portals.

  After filling out the form, a printout needs to be taken, signed by the authorized signatory, and sent to the designated address along with the required documents.

6. Submit the Application

  Submit the signed application form along with the necessary documents to the NSDL or UTIITSL office in India.

7. Pay the Processing Fee

  The processing fee for issuing a PAN card for a foreign entity is generally higher than that for Indian citizens or companies. The payment can be made online via credit/debit card, demand draft, or net banking.

8. Track the Application Status

  Once the application is submitted, the status can be tracked online using the acknowledgment number provided during the submission process.

9. Receive PAN

  Upon successful verification of the application and documents, the PAN will be allotted, and the card will be dispatched to the address mentioned in the application form. 


Points to Consider

  The foreign company should ensure that all documents are correctly attested and verified to avoid any delays in the application process.

  In some cases, the PAN card may be sent to the foreign address, so ensure that the address is correctly mentioned.

By following these steps, a foreign company can successfully apply for a PAN in India and comply with the necessary financial regulations.
